Terms of Service - Language Cafe

1. Agreement to Terms

By downloading, installing, or using the Language Cafe mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

These Terms constitute a legally binding agreement between you and Language Cafe ("we," "our," or "us") governing your use of the App and related services.

2. Eligibility

2.1 Age Requirements

You must be at least 13 years old to create an account and use Language Cafe
If you are under 18, you represent that you have your parent's or guardian's permission to use the App
Users under 13 are not permitted to use Language Cafe

2.2 Account Accuracy

You must provide accurate, current, and complete information when creating your account
You must promptly update your information if it changes
You are responsible for maintaining the confidentiality of your account credentials
You are responsible for all activities that occur under your account

3. Description of Service

Language Cafe is a mobile application that provides:

Voice Rooms: Live audio chat rooms for practicing language conversation
Communities: Groups for language learners to connect based on shared interests
Social Features: Profiles, posts, following, and messaging within the platform
Language Matching: Tools to connect users based on languages they speak and want to learn

Language Cafe is a platform for language practice and does not provide formal language instruction or certification.

4. User Conduct

4.1 Acceptable Use

You agree to use Language Cafe only for lawful purposes and in accordance with these Terms. You agree NOT to:

Violate any applicable laws, regulations, or third-party rights
Post, share, or transmit content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
Impersonate any person or entity, or falsely state or misrepresent your affiliation with any person or entity
Engage in harassment, bullying, stalking, or intimidation of other users
Post content that sexualizes minors or is inappropriate for users under 18
Promote violence, hatred, or discrimination based on race, ethnicity, religion, gender, sexual orientation, disability, or other protected characteristics
Share personal information of others without their consent
Use the App for commercial purposes, advertising, or spam without authorization
Attempt to gain unauthorized access to other users' accounts or our systems
Interfere with or disrupt the App's functionality or servers
Collect or harvest user information without consent
Use automated systems (bots, scrapers) to access the App

4.2 Content Standards

All content you create or share on Language Cafe must:

Be appropriate for a diverse, international audience
Respect the intellectual property rights of others
Not contain malware, viruses, or harmful code
Comply with our Community Guidelines

5. Voice Rooms

5.1 Voice Room Conduct

Voice rooms are public spaces shared with other users
You are responsible for your spoken and written communications in voice rooms
Room hosts have the authority to moderate their rooms, including muting or removing participants
Respect the topic, language, and rules set by the room host

5.2 Content Warnings

Rooms discussing sensitive topics must be appropriately marked
Rooms restricted to users 18+ must be clearly labeled
Users under 18 are prohibited from accessing 18+ rooms

5.3 No Recording

You may not record voice rooms without the explicit consent of all participants
Unauthorized recording may result in account termination and legal action

6. User Content

6.1 Ownership

You retain ownership of the content you create and share on Language Cafe ("User Content"). By posting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, display, reproduce, modify, and distribute your User Content in connection with operating and providing the App.

6.2 Responsibility

You are solely responsible for your User Content. We do not endorse any User Content and are not liable for any User Content posted by you or other users.

6.3 Removal

We reserve the right to remove any User Content that violates these Terms or our Community Guidelines, without prior notice.

7. Intellectual Property

7.1 Our Rights

The App, including its design, features, content, and code, is owned by Language Cafe and protected by intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the App without our written permission.

7.2 Trademarks

"Language Cafe" and our logo are trademarks of Language Cafe. You may not use our trademarks without prior written permission.

8. Third-Party Services

Language Cafe uses third-party services to provide its features:

Firebase (Google): For authentication, database, and cloud services
Agora: For real-time voice communication
Apple/Google Sign-In: For authentication options

Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the actions of third-party service providers.

9. Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your personal information.

10. Account Termination

10.1 By You

You may delete your account at any time through the App settings or by contacting us. See our Account Deletion page for instructions.

10.2 By Us

We may suspend or terminate your account at any time, with or without notice, for any reason, including:

Violation of these Terms or Community Guidelines
Illegal or harmful behavior
Request from law enforcement or government agency
Extended period of inactivity
Discontinuation of the App or any service

10.3 Effect of Termination

Upon termination, your right to use the App ceases immediately. We may delete your account data in accordance with our Privacy Policy.

11. Disclaimers

11.1 "As Is" Service

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

11.2 No Guarantee

We do not guarantee that:

The App will be available at all times or without interruption
The App will be error-free or that defects will be corrected
The App will meet your specific requirements or expectations
Any content or information obtained through the App is accurate or reliable

11.3 User Interactions

We are not responsible for the conduct of users on or off the App. You interact with other users at your own risk. We recommend exercising caution and good judgment in all interactions.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LANGUAGE CAFE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

Your use or inability to use the App
Any conduct or content of any third party on the App
Unauthorized access, use, or alteration of your content
Any other matter relating to the App

13. Indemnification

You agree to indemnify, defend, and hold harmless Language Cafe and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorney's fees) arising from:

Your use of the App
Your violation of these Terms
Your violation of any third-party rights
Your User Content

14. Dispute Resolution

14.1 Informal Resolution

Before filing a formal dispute, you agree to try to resolve any dispute informally by contacting us at contact@languagescafe.com.

14.2 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Language Cafe is established, without regard to its conflict of law provisions.

15. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by:

Posting the updated Terms on this page
Updating the "Last updated" date
Sending a notification through the App for significant changes

Your continued use of the App after changes become effective constitutes your acceptance of the revised Terms.

16. General Provisions

Entire Agreement: These Terms, along with our Privacy Policy and Community Guidelines, constitute the entire agreement between you and Language Cafe
Severability: If any provision of these Terms is found invalid or unenforceable, the remaining provisions will continue in effect
No Waiver: Our failure to enforce any provision does not constitute a waiver of that provision
Assignment: You may not assign or transfer your rights under these Terms without our consent
